1. About The Prospector

The Prospector is a recruiting management platform — the Recruiting Operating System for Athletic Organizations. It provides coaches and staff across universities, colleges, prep schools, sports academies, club programs, youth programs, independent recruiting staffs, and amateur athletic organizations with tools to manage prospect relationships, recruiting events, staff evaluations, communications, and organizational recruiting memory.

By creating an account and using The Prospector, you agree to these Terms of Service. Please read them carefully before using the platform.

2. Independent Platform Disclaimer

Any reference to governing bodies, divisions, conferences, or organizations within the platform is for identification and organizational purposes only at the direction of the customer.

3. Compliance Responsibility

You and your organization are solely responsible for complying with all applicable rules, regulations, and policies, including but not limited to:

• NCAA, NAIA, NJCAA, USCAA, or other governing body recruiting rules and eligibility requirements
• Conference-specific recruiting policies, dead periods, and contact calendars
• League, club, and youth organization regulations applicable to your program
• Institutional policies set by your school, academy, or athletic department
• Federal, state, and local laws applicable to your recruiting activities
• FERPA and any other privacy laws governing student-athlete or minor-athlete information

Recruiting rules vary by sport, division, governing body, and institution and change frequently. It is your responsibility to stay current with all rules applicable to your program. Nothing in The Prospector constitutes a representation that your activities are compliant with any rule or regulation.

4. Branding, Logos, and Workspace Customization

The Prospector allows users to customize their workspace with organization names, logos, color schemes, mascots, trademarks, and other branding elements solely to create a familiar, personalized, and visually enhanced user experience. These customization features exist for identification, personalization, and visual experience purposes only.

The display of any organization name, logo, trademark, color scheme, mascot, conference name, league name, school name, university name, academy name, club name, or other branding within The Prospector does not imply ownership, endorsement, sponsorship, approval, partnership, or affiliation between The Prospector and the respective organization.

All trademarks, logos, names, branding materials, and intellectual property displayed within customer workspaces remain the property of their respective owners.

5. Customer Content and Intellectual Property Responsibility

Users and customer organizations are solely responsible for ensuring they possess all rights, permissions, licenses, authorizations, and approvals required to upload, display, store, or use any logos, trademarks, branding materials, images, videos, content, recruiting information, or intellectual property within the platform.

The Prospector does not verify ownership of uploaded branding materials and assumes no responsibility or liability for any unauthorized, improper, unlawful, or infringing use of trademarks, logos, branding assets, or other intellectual property uploaded by users.

By uploading or using any branding materials within the platform, you represent and warrant that you have the legal authority to do so, and that such use does not infringe the rights of any third party.

You agree to indemnify, defend, and hold harmless The Prospector, its operators, employees, contractors, and agents from and against any claims, damages, liabilities, losses, expenses, or legal costs (including reasonable attorneys' fees) arising from your use of uploaded branding materials, trademarks, logos, or other intellectual property.

6. Data Ownership

You retain full ownership of the recruiting data, prospect profiles, notes, evaluations, event records, and content you enter into The Prospector. We do not claim ownership of your data. Your data is used solely to operate and improve the platform for your account.

Upon account termination, you may request an export of your data by contacting hello@theprospector.pro. We will retain your data for 30 days following termination, after which it will be deleted from our systems.

7. Account Suspension and Termination

The Prospector reserves the right to suspend or terminate accounts that:

• Violate these Terms of Service
• Upload or use content that infringes third-party intellectual property rights
• Engage in activities that violate applicable laws or regulations
• Use the platform to facilitate harassment, fraud, or harm to others
• Abuse platform resources or attempt to compromise platform security or integrity

Where possible, we will provide notice before suspension and a reasonable opportunity to resolve the issue.

8. Disclaimer of Warranties

The Prospector is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or that any particular feature will remain available. Your use of the platform is at your own risk.

9. Limitation of Liability

To the maximum extent permitted by applicable law, The Prospector and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including any recruiting compliance violations, lost prospects, data loss, reputational harm, or penalties assessed by any governing body or institution.

10. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the date at the top of this page. For material changes, we will notify account holders by email. Continued use of the platform after updated Terms are posted constitutes acceptance of the revised Terms.
